What are Injunctions
Injunctions can also be known as Protective Orders or Restraining Orders

Injunctions provide legal protection against someone who is:
harassing, following, or contacting you against your will,
or
making you fear for your safety
🚫 Injunctions legally prohibit the person you’re filing against from having any contact with you
This includes:

Email
Text
Letter
Social Media
Contact through 3rd Parties
Any other form of contact
They are also required to stay away from you at your:
Home
Car
Work
School
Place of Worship
Any other place the Judge feels is necessary for your protection
Types of Injunctions
Domestic Violence Injunction:
Requirements:
The person you are filing against must be family or a household member
In Florida, family or household members include spouses, former spouses, anyone related to you by blood or marriage, anyone currently living together as if they are family or who have done so in the past, or anyone who have children together, whether married or not
You must currently reside together or have resided together in the past, in the same single dwelling unit, unless you have a child in common, in which case you are not required to have resided with them
Does NOT require any actual physical violence, just a well-founded fear of future violence
Stalking Injunction:
Requirements:
Applicable when you have 2 or more incidents of someone stalking or cyber-stalking you, meaning they followed, harassed, or engaged in cyber-stalking
Their actions caused you substantial emotional distress
Their actions served no legitimate purpose
Dating Violence Injunction:
Requirements:
You must have dated in the last 6 months
You must have had an expectation of affection or had sexual involvement with the person you’re filing against
You must have interacted with the person you’re filing against on a regular basis during the relationship, not only one time
Repeat Violence Injunction:
Requirements:
Involves neighbors, co-workers, students, relatives who never lived together, friends, or roommates
Need to have 2 incidents of violence or 2 threats of violence that made you fearful of the person you’re filing against
Sexual Violence Injunction:
Requirements:
You must have reported the incident and cooperated with law enforcement, OR
If the person you’re filing against was sentenced to state prison for sexual violence against you or your child, and has been released from prison, or is going to be released within 90 days

Injunction Process
First, you file your Petition for Injunction, which is a sworn statement that is reviewed by the Judge, who then makes a decision on granting your Injunction through a court order that would require the person you’re filing against to refrain from contact you in any capacity, by law
Judges may review your Petition within 24 hours
After reviewing your Petition, the Judge can:
Decide to grant your Petition, then issue a Temporary Injunction, schedule a Hearing within 2 weeks or less, and have the person you’re filing against served with a Notice of Hearing
Decide to not issue a Temporary Injunction, but still schedule the case for a Hearing within 2 weeks or less, and have the person you’re filing against served with a Notice of Hearing
Decide to deny your Petition, not schedule the case for a Hearing, and the case will be dismissed
(If the Judge decides to deny your Petition, you still have options with refiling)
